Acceptance of the Terms

These terms of service are entered into by and between you and Modified Milsim, LLC (“Modified Milsim,” “Company,” “we,” or “us”). These terms, together with any documents they expressly incorporate by reference (collectively, “Terms”), govern your access to and use of https://modifiedmilsim.com, including any content, functionality, products and services offered on or through it (the “Website”).

By using the Website or placing an order, you accept and agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, our Refund Policy and our Shipping Policy, each incorporated here by reference. If you do not agree, you must not access or use the Website.

Eligibility and Age Requirements

This Website is offered to users who are 18 years of age or older. By using it you represent that you are of legal age to form a binding contract. You must be at least 18 years old to purchase airsoft guns, gas, magazines, knives, or any product in our Real Steel section. Where local law sets a higher age, that age applies. We may request proof of age and may cancel any order where we cannot verify eligibility. We do not knowingly collect information from persons under 13.

Changes to the Terms

We may revise these Terms at any time in our sole discretion. Changes are effective when posted and apply to all use of the Website thereafter, except that changes to dispute-resolution provisions will not apply to disputes of which the parties had actual notice before the change was posted. Your continued use of the Website after changes are posted means you accept them.

Accessing the Website and Account Security

We may withdraw or amend the Website, or any product or material we provide on it, without notice, and are not liable if any part of the Website is unavailable at any time. To use parts of the Website you may need to provide information such as your name, email address and shipping details. You agree that all information you provide is correct, current and complete, and is governed by our Privacy Policy.

Airsoft Products

Airsoft guns are not firearms, but they can be mistaken for real firearms and can cause injury if misused. By purchasing airsoft products you agree that:

•           Airsoft guns are sold for recreational and sporting use only, with appropriate eye and face protection.

•           Airsoft guns are shipped with a blaze-orange tip as required by federal law (15 U.S.C. § 5001 and 16 C.F.R. Part 1150). You will not remove, cover or alter the orange marking, and you are solely responsible for the consequences if you do.

•           You will not brandish, display or use an airsoft gun in public or in any manner that could cause alarm or be mistaken for a real firearm.

•           You are responsible for knowing and complying with all federal, state and local laws where you live, including cities and counties that restrict the sale, possession, transport or appearance of airsoft or imitation firearms. We may decline to ship to locations where sale is restricted.

•           Green gas, CO2 and other propellants are hazardous materials. They can only be shipped by ground service, may be restricted in some locations, and must be stored and used according to the manufacturer’s instructions.

Real Steel Products

Our Real Steel section offers optics, lights, knives, survival and medical supplies, tactical gear and related accessories. Some Real Steel products are fulfilled and shipped directly by our U.S. distribution partner. By purchasing Real Steel products you agree that:

•           You are at least 18 years old (or older where required by law) and legally permitted to purchase and possess the product where it will be delivered.

•           You are responsible for complying with all federal, state and local laws that apply to the product, including laws governing knives, optics, tactical gear and the transport of such items.

•           Some products cannot be shipped to certain states, cities or territories. Where a restriction applies we will block shipment at checkout where possible or cancel and refund the order.

•           Items shown on the Website as “Not available for online purchase” are displayed for reference only and cannot be ordered.

•           We do not sell firearms, firearm frames or receivers that are regulated as firearms, ammunition, suppressors, or any item regulated under the National Firearms Act.

Online Purchases

This Website is powered by Shopify. Payments are processed by Shopify Payments and its payment partners; payment card information is collected and processed by them and is not stored on our servers. Shopify’s terms and privacy policy also apply to the checkout process (see shopify.com/legal/terms).

All orders are subject to acceptance and availability. Product images and descriptions are provided by us and our suppliers; minor differences in color, markings or packaging may occur. We reserve the right to refuse, limit or cancel any order at any time, including for product unavailability, errors in pricing or product information, age or legal restrictions, or concerns flagged by fraud detection. If we cancel an order after payment, we will issue a full refund. By placing an order you represent that the products will be used only for lawful purposes.

Pricing and Sales Tax

Prices are in U.S. dollars. Applicable sales tax is calculated at checkout based on the delivery address and the laws of the destination jurisdiction.

Shipping, Returns and Refunds

Shipping is governed by our Shipping Policy, and returns and refunds by our Refund Policy. Title and risk of loss pass to you when the product is delivered to the carrier.

Intellectual Property

The Website and its contents, features and functionality, including text, images, video, logos and the design and arrangement of the Website, are owned by the Company, its licensors or other providers and are protected by U.S. and international copyright, trademark and other intellectual property laws. You may use the Website for your personal, non-commercial use only. Trademarks

The name Modified Milsim, our logos, and related names, designs and slogans are trademarks of the Company. All other brand names, product names and trademarks shown on the Website (including manufacturer and licensed brand names) belong to their respective owners. Their use on the Website identifies the products we sell and does not imply endorsement by or affiliation with those owners unless expressly stated.

Product Information and Fitment

We work to describe products and compatibility accurately, but airsoft parts may require fitting, and manufacturers can change specifications without notice. Compatibility information is provided as guidance. Installation of parts and upgrades is at your own risk, and modifications may void a manufacturer’s warranty.

Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

•           Use the Website in any way that violates any applicable federal, state, local or international law, including export control laws.

•           Purchase products for resale to persons who are not legally permitted to own them, or for shipment to a location where they are prohibited.

•           Exploit, harm or attempt to harm minors in any way.

•           Send unsolicited advertising or spam, or impersonate the Company, an employee, or any other person.

•           Use any robot, scraper or other automated means to access or copy the Website, or interfere with its proper working, including introducing malicious code or attempting unauthorized access.

Links and Social Media

The Website may link to our social media pages and to third-party websites. When you follow those links you leave the Website and are subject to those sites’ own terms and privacy policies. We are not responsible for their content or practices. You may link to our homepage in a way that is fair and legal, but not in a way that suggests any association or endorsement without our written consent, and you may not frame or deep-link the Website.

Geographic Restrictions

The Company is based in the State of Arizona. The Website is intended for users in the United States. We make no claim that the Website or its products are appropriate or lawful outside the United States, and we currently ship only within the United States.

Disclaimer of Warranties

YOUR USE OF THE WEBSITE AND ANY PRODUCTS OBTAINED THROUGH IT IS AT YOUR OWN RISK. EXCEPT AS EXPRESSLY STATED IN OUR REFUND POLICY OR BY A MANUFACTURER’S WARRANTY, THE WEBSITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, SUPPLIERS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE OR ANY PRODUCT, INCLUDING DAMAGES ARISING FROM THE MISUSE, MODIFICATION OR UNLAWFUL USE OF ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. Indemnification

Governing Law and Jurisdiction

These Terms and any dispute arising from them or from the Website are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any legal action shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction and venue of those courts.

Limitation on Time to File Claims

ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE IT IS PERMANENTLY BARRED, TO THE EXTENT PERMITTED BY LAW.

Waiver and Severability

No waiver of any term is a further or continuing waiver of that term or any other term. If any provision of these Terms is held invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy and Shipping Policy, are the entire agreement between you and Modified Milsim regarding the Website.
